Mr. Ben T.C. Chan is a practising Barrister-at-Law and a trailblazer in construction dispute resolution, uniquely bridging civil engineering, quantity surveying, and construction law with years of cross-disciplinary leadership.

Renowned for his strategic acumen, he has resolved high-stakes disputes across mega-projects—including tunneling, reclamation, piling, and high-rise developments—often involving claims exceeding tens or hundreds of millions.

A Chartered Civil Engineer, Quantity Surveyor, and Construction Manager, Mr. Chan combines technical mastery with legal acumen. He holds a Master of Laws in Arbitration and Dispute Resolution and is a Fellow of prestigious institutions including the ICE, RICS, ICES, CIArb and HKIArb. His unique blend of qualifications spans engineering design, contract management, and dispute resolution, underpinned by over a decade of senior leadership in major infrastructure and construction projects.

As Deputy Chairman of the Construction Dispute Resolution Committee of the Hong Kong Institution of Engineers (HKIE) from 2023 to 2025, he has played an instrumental role in shaping Hong Kong’s construction dispute resolution landscape. His leadership was pivotal during the legislative development of the Security of Payment Ordinance, where he collaborated closely with the Development Bureau to refine adjudication practices and enhance statutory frameworks. Currently Head of Commercial at Yau Lee Holdings, Mr. Chan oversees high-stakes contractual and commercial practices and strategies.

 

Programme Highlight: 

In order to improve delay payment problems in construction industry and provide better protection for stakeholders in supply chains of construction industry to receive their entitled payment on time, the Construction Industry Security of Payment Ordinance (CAP 652 of the Laws of Hong Kong) was gazetted on 27 December 2024 and to be formally enforced for construction contracts entered into on or after 28 August 2025.

The Ordinance covers contracts for carrying out construction work with min. contract value of HK$5 million and supply of related goods and services related to construction works with min. contract value of HK$ 500,000.

This seminar will cover the basic information for SOPO, including the followings, to let building engineers in the industry to have the most update knowledge.

 

-Application of SOPO in main private contract & public contract for new works & repair and alteration works

-Payment claims and payment response deadline

-Adjudication proceedings and timeline

-Right to suspend or reduce the rate of progress

-Case studies
